Live with me at 10 a.m. Eastern as the Supreme Court hears oral arguments in two Helms-Burton Act, Title III cases about Cuba property claims and foreign sovereign immunity. If you have ever wondered when U.S. companies can sue over property seized during the Cuban Revolution, and whether a foreign government or its state-owned companies can be hauled into a U.S. courtroom, this live is for you. Today’s live covers Exxon v. Cimex Cuba (24-699) and Havana Docks v. Royal Caribbean (24-983). Both cases turn on how the Libertad Act of 1996, also known as the Helms-Burton Act, works in practice, and how it intersects with the Foreign Sovereign Immunities Act. We will talk about what Title III allows, what “trafficking” means in the statute, why presidents paused Title III for decades, and why the litigation wave took off after it was turned on. In Exxon v. Cimex Cuba, the big question is whether Cuba’s state-owned entities can be sued under Title III at all. Does Helms-Burton create an exception to foreign sovereign immunity, or does the FSIA require a clear written exception. The argument also tees up the commercial activity issues, including whether selling U.S. products is enough to strip immunity. In Havana Docks v. Royal Caribbean, the dispute is a timeline problem that becomes a damages problem. Havana Docks claims rights in a dock lease that Cuba effectively took, but the lease expired in 2004 and the cruise ship activity at issue comes years later. So the Court has to grapple with whether Title III reaches conduct after the underlying property rights may have ended.
