At approximately 1:40 PM, a 2013 Chevrolet Spark, bearing Arizona license plate YUMA310 approached the primary inspection position. The driver, later identified as Robert Edward TRUDELL Jr., did not have his window rolled down and was looking straight ahead. Agent b6b7C using hand motions, attempted to have TRUDELL roll his window. TRUDELL continued to stare straight ahead refusing to acknowledge Agent b6b7c presence. Agent b6b7C then identified himself as U.S. Border Patrol agent and questioned TRUDELL as to his citizenship. Trudell quickly looked at Agent b6b7C but refused to answer any of Agent b6b7C questions regarding his citizenship. Agent b6b7C informed TRUDELL that he needed to move his vehicle into the secondary inspection area for further investigation. TRUDELL began looking around bu still refused to comply with Agent b6b7C command. Agent b6b7C informed TRUDELL he was obstructing the flow of traffic thus causing a highway safety hazard and he needed to move his vehicle into the secondary inspection area. TRUDELL again refused to acknowledge the command. At approximately 1:46, utilizing his service radio, Agent b6b7C called for a supervisor and canine to respond t the primary inspection area. Supervisory Border Patrol Agent b6b7C responded to primary and again questioned TRUDELL as to his citizenship. TRUDELL did not acknowledge Agent b6b7C presence and again refused to answer any questions. Instead TRUDELL was focused on using his many cameras in order to take videos and pictures of the checkpoint and the agents. Agent b6b7C then backed away from the scene in order to inform Border Patrol Dispatch of the event and request contact be made with b7E At approximately 1:55, a b7E arrived on scene and informed Agent b6b7C they were unable to provide any service because it was out of their jurisdiction. While Agent b6b7c conversed with b7E TRUDELL continuously placed his hands in areas of the vehicle where Agent b6b7C was unable to view. TRUDELL also quickly turned and put his hands into the back seat and Agent b6b7C tapped on the window and instructed TRUDELL to make his hands visible. TRUDELL quickly turned around, this time grasping a plastic bag with both hands. Agent b6b7C maintained visual of TRUDELL and witnessed him methodically removing small black objects from the bag. Agent b6b7C again approached the window and directed TRUDELL to the secondary inspection area. Again TRUDELL refused to move his vehicle. Agent b6b7C asked TRUDELL if he was refusing to comply with the order directing him to the secondary inspection area. At approximately 1:58 PM, TRUDELL, without speaking, moved his vehicle toward secondary. In the secondary inspection area, Agent b6b7C requested that TRUDELL exit the vehicle but TRUDELL continued to stare straight ahead without acknowledging the request. Agent b6b7C the gave TRUDELL a command to exit the vehicle and again TRUDELL refused to obey the command. At this time, TRUDELL was attempting to operate a camera and on multiple occasions placed his hands out of the view of Agent b6b7C Agent b6b7C then informed TRUDELL that if he refused to exit the vehicle, he would be removed by force. TRUDELL ensured his glasses, later determined to be safety goggles, were correctly situated on his face and he braced himself by grabbing the steering wheel. Receiving no acknowledgement from TRUDELL, Agent b6b7C broke the window and opened the door. Agent b6b7C then grabbed TRUDELL's arm and removed him from the vehicle. Agent b6b7C performed a cursory pat down for weapons and turned TRUDELL over to Supervisory Border agent b6b7B who placed him under arrest at approximately 2:01. A protective sweep was done on the vehicle ensuring there were no weapons inside. During the sweep, agents discovered handcuffs, a window-breaker, a baton, a life-vest displaying a badge and 27 filming/recording devices. TRUDELL was transported to the Campo Border Patrol Station located in Pine Valley, California for further processing. At the station TRUDELL's biographical and biometric information was inputted into Border Patrol processing systems. TRUDELL was also interviewed regarding the day's event; however, opted to not speak without an attorney present. The 2013 Chevrolet Spark had not been reported stolen and b7E, The vehicle was towed and stored at the owner's expense. TRUDELL was charged and booked with 18 USC 111, assaulting, resisting or impeding certain officers and released.
