Around 1:47 AM on December 6, 2025, Officers Francisco Silva and Stephen Molenda with the Villa Park Police Department were patrolling near DeMito’s Saloon around closing time. Officer Silva heard a loud noise of some kind of metal being struck by another vehicle. He noticed a tan 2015 Lexus GX striking a curb, and the Lexus nearly struck his squad car while driving past him. The driver of the Lexus later continued northbound on Villa Avenue. It was later determined that the driver had struck a street sign. Officer Silva initiated a traffic stop on Villa Avenue near Wildwood Avenue. He made contact with the driver, who was later identified as 23-year-old Victoria Rutkowski. Victoria initially claimed that she was heading home from work in Oak Brook, but she would later admit to having been at DeMito’s. As he was speaking with her, he detected the odor of alcohol and observed other indicators of impairment. Victoria was having trouble locating all her documents, and she admitted to consuming 2 shots of alcohol earlier that evening. Based on his suspicion of impairment, Officer Silva decided to administer field sobriety exercises. Her poor performance on the field sobriety exercises confirmed his suspicion of impairment. Following the field sobriety exercises, Victoria was offered an opportunity to submit to a PBT, and the results indicated a BAC level of 0.232%. Based on her erratic driving, the odor of alcohol, her admission to drinking earlier that evening, and her inability to adequately perform the field sobriety exercises, Officer Silva placed Victoria under arrest for driving under the influence. Victoria was transported to the Villa Park Police Department for further processing. She agreed to submit breath samples at the station and Officer Hylton administered the breath test. The results indicated a BAC level of 0.221%, which was nearly triple the legal limit of 0.08%. After they finished processing her, Victoria was released pending her court appearance at the DuPage County Courthouse on January 7, 2026.
