The National Seminar on ‘Science in the Courtroom: Examining Forensic Evidence’ was organised by Project 39A on 11th May 2024 to reflect on the current issues with the legal standards and practice regarding forensic evidence in India. Eminent legal and forensic experts from India, the United States of America, and Australia came together to highlight the importance of valid and reliable forensic science for the criminal justice system. In this session, Mr. M. Chris Fabricant, Director of Strategic Litigation at the Innocence Project, discusses the significant role that unreliable forensic disciplines have played in wrongful convictions. He also shares compelling accounts as narrated in his book, ‘Junk Science and the American Criminal Justice System,’ about the rise of bite mark analysis as a forensic discipline in the US and the ongoing efforts to challenge this scientifically unreliable evidence in criminal cases. Reflecting on his journey as a defence lawyer, he shares his insights on how to keep this ‘junk science’ out of courtrooms.
