무역대금결제 신용장의 개념

신용장은 수입업자의 거래은행 ( 발행은행 ) 이 수입업자 ( 발행의뢰인 ) 의 요청으로 수출업자로 하여금 일정기간 내에(신용장 유효기간) 일정조건(신용장에 기재된 조건)하에서 선적서류 또는 어음과 선적서류 등이 일치하는 제시를 구성하는 경우 은행이 대금을 지급하겠다고 약속하는 ‘은행의 조건부 지급확약서’ 라고 정의할 수 있다. 신용장의 발행계약은 먼저 신용장 발행은행과 발행의뢰인 간에는 일종의 신용장발행계약이라 할 수 있는 외국환거래약정의 체결에 의해 성립된다. 신용장거래약정에 의한 신용장발행계약은 매매계약과는 완전히 독립적이며 당사자 간의 법률관계를 형성하게 된다. 그러므로 신용장발행계약에 있어서 신용장 발행은행은 발행의뢰인으로부터 일정한 수수료를 받고 위임을 받아 제3자와 계약을 체결하는 일종의 지급대리인으로서의 의무를 부담하게 된다. 발행은행은 발행의뢰인인 수입업자에 대한 신용조사와 함께 채권확보의 방책으로 수입업자와 외국환거래약정을 체결하고, 대금지급에 대한 채무를 부담하는 대가로 수입업자로부터 담보제공으로서 수입물품 자체를 양도담보로 요구함은 물론 필요할 경우 추가담보 설정 등을 고려하여 신용장발행한도를 설정하게 된다. 강의가 좋으시면 강의 화면 오른쪽 하단이나 왼쪽 상단에 tradelecture 로고를 누르시거나, 유튜브에서 보기 하셔셔 좋아요. 구독 부탁드립니다. 자료출처 : A+ 무역영어, 이기영, 서울고시각, 2009-2018 If you like the lecture, please click on the tradelecture logo in the lower right or upper left corner of the lecture screen, or watch it on YouTube.
