A major shift is underway in how Florida courts treat traffic stops involving marijuana. Two appellate courts — the 2nd District in Tampa and the 5th District in Orlando/Daytona — have now ruled that the smell of marijuana by itself is no longer enough for police to search a vehicle. For decades, the so-called “plain smell doctrine” allowed officers to claim they smelled marijuana and use that alone as probable cause. But judges now say the rise of legal hemp and medical marijuana makes odor too unreliable to separate legal from illegal cannabis.
