Is former president Rodrigo Duterte, covered by the protection of US President Donald Trump's sanctions, on the International Criminal Court (ICC)? Senate Foreign Relations Committee Chair - Imee Marcos, asked this question as she singled out a provision of Trump's order. The movement calling for the return of former President Rodrigo Duterte to the Philippines, welcomed the enforcement of an executive order issued by U.S. President Donald Trump on 6 February. The order, which takes effect on April 6, effectively places Duterte under protection from any arrest or prosecution by the International Criminal Court (ICC). Under the Trump executive order, ICC and Philippine officials allegedly responsible for Duterte’s kidnapping and detention at the ICC in The Hague Netherlands, are now subject to U.S. government sanctions. The executive order declares that the ICC, as established by the Rome Statute, has engaged in illegitimate and baseless actions targeting the U.S. and its allies. The White House executive order imposing sanctions on the International Criminal Court Stated that, The United States unequivocally opposes, and expects their allies to oppose any ICC actions, against the United States, Israel, or any other ally of the United States, that has not consented to ICC jurisdiction. Under section 8-D2 defines the term, protected person under this executive order. Protected persons means any United States person and any foreign person, that is a citizen or lawful resident of an ally of the United States, that has not consented to ICC jurisdiction over that person, or is not a state party to the Rome Statute, including: Current or former members of the armed forces of such ally of the United States. Current or former elected or appointed government officials of such ally of the United States. And any other person currently or formerly employed by, or working on behalf of such a government. Executive order Section 8-E, defines the terms ally of the United States. Under sub section 2, a government of a major non-NATO ally, as that term is defined by section 2013(7) of the American Servicemembers’ Protection Act of 2002, based on section 517 of the Foreign Assistance Act of 1961. Major non-NATO Ally status is a designation under U.S. law that provides foreign partners with certain benefits in the areas of defense trade, and security cooperation. Currently, there are 19 countries designated as Major Non-NATO Ally Status under US Law which includes the Philippines. It was confirmed, that under this executive order, Rodrigo Duterte, as a former president of the Philippines. A former government elected official, of a major non-NATO ally is protected under this executive order of the President of the United States. As a consequence, any individual from any groups or government agencies will be sanctions under Section 1 of these order. The United States will impose tangible and significant consequences on those responsible for the ICC’s transgressions, some of which may include the blocking of property and assets, as well as the suspension of entry into the United States of ICC officials, employees, and agents, as well as their immediate family members, as their entry into to the US would be detrimental to the interests of the United States. The Allies of Rodrigo Duterte are expecting a freezing of assets and a ban on U.S. entry for all people involved in the so-called Operation Hot Pursuit carried out against the former President. Aside from ICC officials, Filipinos who contributed to building the so-called crimes against humanity case may also be affected by the U.S. sanctions. Trump invoked authority granted to him under the U.S. Constitution and laws, including the International Emergency Economic Powers Act section 212(f) of the Immigration and Nationality Act of 1952, and section 301 of Title 3 of the U.S. Code. As stated, Trump said that the ICC has without a legitimate basis, asserted jurisdiction over, and opened preliminary investigations concerning personnel of the United States and certain of its allies. The ICC has no jurisdiction over the United States or Israel, as neither country is party to the Rome Statute or a member of the ICC.
