I want to talk to one of the most common questions that I get, people call into the office and say, hey, I don't have a current case right now, but I have a previous misdemeanor conviction. And I want to know, can I get that expunged? Does your firm handle that? First answer is yes, we do handle that. We handle expungements all the time. Can your case be expunged? Well, that depends on your case. It depends on the nature of your charges. Depends on what your sentence was. And it depends on how long ago was your conviction. For example, the most common expungement request we get at the misdemeanor level is somebody who has been convicted of a DUI and they've done their probation, they've done all the classes, they've paid off all the fines, but that conviction is still appearing on their background check. And a lot of employers will not hire people with DUI convictions. The reason for that is most corporations have insurance policies and they have a little black book of what types of crimes they will not insure. And DUI is at the top of that list. Usually in companies that require a person to drive company vehicles or drive their own vehicle to meet with clients, to fly out of town and rent a vehicle. And so they say, listen, I did my punishment, but this DUI is still punishing me. So can we get that expunged? The answer is most likely yes. What we have to do is we need to meet with you. We need to look at all of your circumstances. We need to review your case, make sure that the probationary period is done, or at least as close to becoming done to where we can also file a motion to terminate that prohibition early and file a petition that outlines all of your circumstances and why in the interest of justice and why there's good cause for a judge to reopen that old case and dismiss your prior guilty plea or criminal conviction from trial.
