SC Refuses To Entertain Petitions Against Assam CM Himanta Biswa Sarma Over Viral Video

The controversy arose over a video showing the Assam Chief Minister aiming a rifle at a target allegedly depicting a particular community. Petitioners approached the apex court seeking action, including registration of an FIR on charges of hate speech and communal polarization. However, a bench comprising Justice Surya Kant, Justice Joymalya Bagchi, and Justice B. M. Pancholi refused to entertain the plea. The Court directed the petitioners to approach the Gauhati High Court instead, emphasizing that the jurisdiction of High Courts should not be bypassed. The bench also observed that there has been a growing trend of bringing politically sensitive matters directly to the Supreme Court ahead of elections. While stressing constitutional morality and restraint in public discourse, the Court stated that not every issue can be brought before the apex court. During the hearing, Senior Advocate Abhishek Manu Singhvi argued that such incidents were recurring and urged the Court to take direct cognizance.
