The lack of harmonised application across EU Member States, and of guidance (until recently) as to what factors controllers should take into account when conducting the balancing test which lies at the heart of the condition, have both created uncertainly. The subject has also attracted a lot of attention in the debate around the planned EU Data Protection Regulation. Credit reference agencies in the UK (and elsewhere) have processed data under the legitimate interests condition for many years and have developed a comprehensive ecosystem of protections for consumers to ensure that the processing occurs fairly. This session will give insight from a company that relies on legitimate interests for core personal data processing as to how in practice a balance is made of the legitimate interests of the controller, and the third parties to whom the data are disclosed, on the one hand and the fundamental rights and freedoms of the data subject on the other. Attend this presentation to understand: • The importance of the legitimate interests condition; • How a responsible balancing test can be conducted; • How (using care and vigilance) it is possible for significant volumes of personal data to be processed under the legitimate interests condition; and • Examples of protections used in credit referencing that companies in other sectors who are interested in relying on this ground might consider deploying to uphold the balance and protect the interests and fundamental rights of data subjects.
