The Fearless Problem

A civil rights law written in 1866 to assist Black people after slavery was used to shut down a grant program for Black women entrepreneurs. "The Fearless Problem" observes the conservative legal strategy behind the dismantling of the Fearless Funde's Strivers grant program for Black women as part of a larger growing effort to redefine discrimination by erasing history from the law. Across the country, race-conscious programs are being targeted not because they have failed, but because they remember too much. Supreme Court decisions now move with studied amnesia, the result is a legal landscape in which discrimination is redefined by pretending it never occurred. That’s the part they leave out.
