UNINCORPORATED, ORANGE COUNTY, FL - On May 6th, 2021 at 2:42AM, a University of Central Florida Sergeant observed a vehicle driving with expired registration. The sergeant activated his emergency lights and pulled the driver over at a fraternity house to begin his investigation. In speaking with the suspect, he noticed that she had watery and bloodshot eyes and could smell the odor of an alcoholic beverage coming from the interior of the vehicle. After retrieving her license, the sergeant called for backup to investigate the suspect for driving under the influence, or DUI. A corporal then continued to speak with the suspect and asked if she had been drinking or smoking earlier in the evening to which she refused. The corporal explained that he had asked because of the suspect's slurred speech and bloodshot eyes to which she claimed she was taking medication to get rid of a stye. The suspect was eventually asked to step out of the vehicle to which she obliged. Once outside the vehicle, the corporal asked the suspect if she would be willing to submit to a field sobriety test to which she agreed. For the horizontal gaze nystagmus test, the suspect had to be reminded not to move her head twice, displayed lack of smooth pursuit in both eyes, distinct and sustained nystagmus in both eyes, and displayed the onset of nystagmus at 45 degrees in both eyes. For the walk-and-turn test, the suspect did not count out loud, took 15 steps forward, did not perform the turn as instructed, and took 16 steps back. For the one leg balance test, the suspect needed to be reminded to look down at her foot and counted the number 12 twice. For the modified Romberg balance test, the suspect had slight eye tremors and estimated the passage of 30 seconds in 21 seconds. The suspect also had to be repeatedly told to move her finger down from her nose after each iteration of the finger-to-nose test. At the conclusion of the tests, the suspect was asked to move both of her hands behind her back and count to 30, but was arrested for DUI while only counting to 17. Following the arrest, the officer guarding the suspect began speaking with the suspect while the sergeant found an open container in her vehicle and eventually a fake ID bearing the suspect's middle and last name in her wallet. The suspect was eventually transported to a DUI processing facility at the Orange County Sheriff's Office whereupon she submitted two evidentiary breath alcohol samples.
