READ DEFINITIONS OF LEGAL TERMS AND WHAT IS GOING ON BELOW! Thumbnail Credit: https://www.artstation.com/miguel_igl... For those that have the incorrect interpretation of what is going on, this legal issue is complex, please read below what the issue actually is that will be seen in court and see GHAMAK's original video here: • Games Workshop Is Suing Me In the video he states GW are accusing him of unfair competition. This may seem like it has nothing to do with intellectual property infringement, but it in fact does. GHAMAK says that this means that because the models he has designed can be used in GW games it is a threat to not only his business but all independent 3D modellers and hobby businesses. GHAMAK is either being deceptive in his interpretation of what 'unfair competition' means or he himself does not understand the definition of 'unfair competition'. Unfair Competition Definition: 'Unfair competition has been defined as the act of any person who shall employ deception or any other means contrary to good faith by which he shall pass off the goods manufactured by him or in which he deals, or his business, or services for those of the one having established such goodwill, or who shall commit any acts calculated to produce said result. (Section 1(t), Rule I, IRR on Administrative Complaints for Violations of Laws Involving Intellectual Property Rights)' Source: https://www.alburolaw.com/what-is-the... Definition Cont: Within Unfair Competition there is also 'Unfair free-riding' or 'Parasitism': 'More specifically, this protection is available when a third party calls to mind the mark with a reputation102 and attempts to ride on the coat-tails of that mark ‘in order to benefit from its power of attraction, its reputation and its prestige, and to exploit, without paying any financial compensation and without being required to make efforts of his own in that regard, the marketing effort expended by the proprietor of that mark' Source: https://academic.oup.com/jiplp/articl... Source: https://www.copyright.eu/docs/unfair-... In this video we have a look at a couple of models from GHAMAK and if there is any level of copy right infringement for the models he has available for sale. If the models are found to infringe the copyright, GW's application to court may be successful. TLDR: GHAMAK's does not define to the viewer what 'Unfair Competition' is. Unfair competition basically means deceptively sell an item that looks very similar to another companies product to exploit the product said company produces. GW claims GHAMAK sells models that are too close in design to their own models GW claim GHAMAK's models are causing their business a loss as those models being sold are deceptively exploiting their own products/models. I shouldn't have had to write all this, as we look at how stupid some of these models are, but some people have claimed this is a slam dunk case for GHAMAK or that this matter is not about copyright (which is absurd!).
