The youth vaping epidemic has been driven in part by the addictiveness of nicotine and its impact on the developing brain. However, the U.S. Food & Drug Administration has been slow to regulate these products to protect youth. Moreover, an emerging class of vaping products that do not contain nicotine but are marketed with wellness and vaping cessation claims present new regulatory challenges. Youth are often duped into trying these products believing they are harmless or even helpful. Not only does scientific uncertainty exist about the risks and benefits of these products, but they are subject to limited regulatory oversight. This panel will discuss regulatory options that exist under current law and what states, localities, and Tribes might consider in regulating these vaping products in the future.
