Effective January 1, 2018, a cultivation tax is imposed on cultivators for all harvested cannabis, except immature plants and seeds, that enters the commercial market based on the weight and category of the cannabis. There are currently three categories: 1. Cannabis Flowers 2. Cannabis Leaves 3. Fresh Cannabis Plant There is no cultivation tax category for a whole dry cannabis plant. You still will be required to pay taxes on the dry whole plant, the CDTFA gives you two forms of guidance on how. Tax Rates Beginning January 1, 2020, the cultivation tax rates increased as an adjustment for inflation. These are not reflected in the video. It's important to note that the cannabis tax law imposes a mandatory 50 percent penalty for failure to pay the amount of cultivation tax or cannabis excise tax due. If you fail to pay the cannabis taxes by your due date, you may be relieved of the 50 percent penalty if the CDTFA finds that your failure to timely pay was due to reasonable cause and circumstances beyond your control, and occurred notwithstanding the exercise of ordinary care and absence of willful neglect.
