It allows a party to make amendments to its pleadings, either by adding or deleting any matter in the original pleading, at any stage of the proceedings, before judgment is pronounced by the court. The objective behind allowing amendments to pleadings is to ensure that the real question in controversy between the parties is effectively and completely determined, and that there is no undue delay in the proceedings. Amendments to pleadings are usually allowed to prevent injustice or to give effect to the substantive rights of the parties. Some of the key provisions of Order 6 Rule 17 of the CPC are as follows: The court may at any stage of the proceedings allow either party to alter or amend his pleadings in such manner and on such terms as may be just. The amendment may be made even after the issues have been framed, provided the amendment does not change substantially the nature of the case. The amendment may be allowed even if it raises a new claim or defense, provided the new claim or defense is not barred by limitation and does not prejudice the rights of the other party. The court may allow the amendment on such terms as to costs or otherwise as it thinks fit. However, there are some limitations on the power of the court to allow amendments to pleadings. For instance, the amendment cannot be made to substitute a new cause of action or claim in place of the original one. Also, the amendment cannot be made if it amounts to giving a completely new case to the party seeking the amendment, which may prejudice the rights of the other party.
