The ruling, issued by Washington DC District Court Judge Ana C. Reyes, marks a key early victory in the case challenging FCC character qualification reviews for amateur radio licenses. The suit, initially filed in October of 2024, alleges that the FCC is attempting to deny the plaintiff's Amateur Radio license application without providing an evidentiary hearing, which the plaintiff, CaptKirk2021, claims is required under the Administrative Procedure Act of 1946, as well as the FCC's own stated Character Policy. Over 250 previously held short-format amateur radio callsigns have just become available for vanity applications, after the expiration of the two-year grace period and many processing delays. Ham radio CW signals, also known as Morse Code, have been found to interfere with certain transponders on Boeing 787 Dreamliners, contributing to an $8 million dollar repair bill for several airlines, including American, United, and Alaska Air.
