Judicial Custody and Police Custody | Arrested vs Custody Police Custody VS Judicial Custody JUDICIAL CUSTODY 1.In judicial custody, the Magistrate has the authority to punish the accused. 2.In judicial custody, the officers cannot interrogate without the permission of the Magistrate 3.In judicial custody, the accused is kept in jail. 4.The judicial custody can be extended till 15 days Or 90 days in case of serious offences POLICE CUSTODY 1.In police custody, the police can interrogate the accused without anyone's permission, be it a Judge or Magistrate. 2.In the police custody, the accused stays in the lockup for 24 hours unless he/ she is proven innocent. 3.It can only be extended upto 15 days.
