In re RealNetworks | 2000 WL 631341 (2000) Most people, when they’re making online purchases or downloading free software on the internet, scroll to the bottom of the pop-up screen and never read all of the fine print. But what if the fine print contains an arbitration clause that waives the right to file a lawsuit? Would it be binding? The United States District Court for the Northern District of Illinois addressed this issue in In re RealNetworks. Michael Lieschke and others downloaded free software offered by RealNetworks. Unknown to the downloaders, the software secretly allowed RealNetworks to access and intercept users’ electronic communications and stored information. In order to download the software, users had to accept a mandatory license agreement that appeared in a pop-up window on the user’s computer screen. Included in the license agreement was a clause requiring users to agree to submit to arbitration rather than file a lawsuit if any legal disputes concerning the software arose. When Lieschke and other users learned that the software had been secretly accessing their computers, they filed a class-action lawsuit in federal court, contending that RealNetwork had trespassed and violated users’ privacy. RealNetworks moved the court to stay the lawsuit and order arbitration under the Federal Arbitration Act. The plaintiffs responded that the arbitration clause was unenforceable because the act requires arbitration agreements to be in writing in order to be binding. Want more details on this case?
