The defense lawyer will argue the opposite. They will try to convince the judge that the evidence is weak, insufficient, or does not constitute an offense. They will argue for the accused to be "discharged" from the case without having to face a trial. After hearing both sides, the judge will decide either to frame the charges (which officially begins the trial) or to discharge the accused (which means the case ends for them).
