The Costantinos sued Dr. Herzog for causing their daughter's Erb’s Palsy during delivery. The plaintiffs' expert said that Dr. Herzog did not follow the standard of medical care while delivering the baby. To support their defense, the defendants cited Williams Obstetrics and introduced a video from ACOG. The plaintiffs objected, but the Judge allowed it as a learned treatise. The plaintiffs appealed, arguing that the video lacked acceptance in the medical profession. The appellate court reviewed the lower court's decision on the admissibility of the video and two articles from the American Journal of Obstetrics and Gynecology. Costantino v. David M.
