In our last lesson, we talked about Article 28 of the Civil Code. Article 28 deals with the prohibition against unfair competition. Again, the law does not prohibit competition in business per se. You are free to make a panciteria right next to the panciteria of your next-door neighbor. What the law prohibits here is unfair competition. Competition is unfair when a person performs an act contrary to good faith, in the course of trade or business and second – this act must be act must result in the injury of a competitor or trade rival. Today, we’re taking a look at Article 29 of the Civil Code. It’s not a particularly long provision but I think it’s a potential source of confusion when read without the proper context. There are a lot of new concepts in this provision, and we’ll try to go through all of them. By the end of this lesson, you should be able to: 1. Enumerate the different degrees of proof or quanta of evidence required for particular proceedings; 2. Explain the basis of civil liability arising from a crime; 3. Identify instances where civil liability may persist, even when there is an acquittal. All of this and more – coming right up. ********************* SHOW NOTES: 1.
