Neumeier - Idaho Supreme Court 415 P.3d 372, 163 Idaho 504 (2018) In contract law, a condition precedent is an event that must occur before a party's contractual duty arises. In Medical Recovery Services versus Neumeier, we explore the various types of contractual conditions precedent. In late twenty twelve, Jared Neumeier received medical services from doctor Eric Baird. Neumeier provided doctor Baird's office with his medical insurance information, expecting the bill to be submitted to his insurer. However, the doctor's office didn't submit the bill to Neumeier's insurer. Instead, it sought payment directly from Neumeier. Unfortunately, the doctor's office sent the bill to an incorrect address. In April twenty fourteen, after receiving no response, Doctor Baird's office assigned Neumeier's delinquent account to Medical Recovery Services, a collection agency. Medical Recovery continued sending notices to an incorrect address and was unsuccessful in its collection efforts. In April twenty fifteen, Medical Recovery finally sent Neumayer a letter at his correct address. On May fourteenth, with no response from Neumayer, Medical Recovery sent the account to its legal counsel. On May eighteenth, after receiving the letter and believing it was a scam, Neumeier visited doctor Baird's office, and discovered that the twenty twelve bill had never been submitted to his insurer. When Neumeier contacted Medical Recovery, he was told it was too late, as the matter had been sent to legal counsel. A month later, Neumeier was served with Medical Recovery's complaint and summons. Doctor Baird's office subsequently submitted the twenty twelve bill to Neumayer's insurer, which paid it. Neumayer was then told that his account was settled. Neumayer moved to dismiss Medical Recovery suit. Medical Recovery objected, arguing that although the principal balance was reduced to zero, it was still entitled to collect prejudgment interest. The trial court found that Neumeier's obligation to pay under his contract with doctor Baird was subject to an implied in fact condition precedent that wasn't fulfilled. Accordingly, the court concluded that no valid debt upon which interest could accrue existed and granted Neumeier's summary judgment. The court of appeals affirmed. Medical Recovery appealed.
