Video Transcript The doctrine of laches is an equitable defence that can prevent a claimant fromenforcing a right or obtaining a remedy if they have unreasonably delayed in assertingtheir claim and that delay has prejudiced the other party. Laches operates where a claimant has slept on their rights by waiting too long to takeaction, and the delay makes it unfair for the claim to proceed. In assessing whether laches applies, courts look closely at the length of the delay, thereasons for that delay, and whether the claimant knew or ought reasonably to haveknown they had a right capable of enforcement. A delay may be explained or excused in some circumstances, such as wherenegotiations were ongoing or where the claimant lacked knowledge of the relevantfacts, but unexplained or strategic delay will weigh heavily against granting relief. Courts also examine whether the delay has caused prejudice to the defendant. This prejudice may take many forms, including loss of documents, faded memories,unavailable witnesses, changes in financial position, or the defendant acting on thereasonable assumption that the claim would not be pursued.
