Correction note: One of the slides says that ‘Community Councils can be statutory consultees’ when it comes to a energy consent application under Section 36 or 37. This is incorrect. Community Councils are statutory consultees for development management purposes for planning applications under the Town and Country Planning Act. They are not however for Section 36 applications under the Electricity Act. Under the Electricity Regulations, statutory consultees are the local planning authority in whose area the site is located, SEPA, NatureScot and Historic Environment Scotland. Community Council's will be consulted by the ECU however. The ECU will agree the list of consultees with the applicant at the First Gatecheck meeting pre-EIA scoping and the relevant Community Councils are usually part of this list. Are feeling confused and overwhelmed about how decisions regarding renewable energy and related infrastructure are made development are being made? Then this introductory session to planning and energy consents processes is the good way to start. This session is split into 2 parts. THIS SESSION IS PART ONE. Part ONE will go through the different consenting processes for renewable energy applications. We will cover the regular town planning application and the Section 36 and 37 applications of the Electricity Act 1989 for larger scale renewable projects.
