Using a recent High Court case as an example, this video explains how, in certain circumstances, the answer can be yes. 🔹 Judicial Review & Student SponsorshipJudicial Review is usually associated with challenges against the Home Office, where there is no right of appeal. However, this case shows that sponsoring educational institutions may also be subject to Judicial Review where their decisions are not public law-compliant. 🔹 The Case of Khan v Coventry University 2025 The case involved a Pakistani student whose university withdrew sponsorship after tuition fees were deemed late despite the correct amount being paid in full. The delay arose due to an administrative error by a fee management company, not deliberate non-payment by the student. 🔹 Public Law Duties of Universities. While universities have wide powers and obligations to monitor students and withdraw sponsorship where necessary, those powers are not unlimited. The High Court confirmed that universities must act fairly, rationally and lawfully when exercising sponsorship decisions. 🔹 Key Findings of the High Court: The judge found that the university arguably. Acted irrationally by failing to reverse sponsorship after payment was received. Fettered its discretion by taking a rigid mechanical approach. Failed even to enquire with the Home Office whether the withdrawal could be rescinded. The court stressed that in unusual cases like this, universities should act with greater flexibility and understanding. 🔹 Why This Matters for Student Migrants. The consequences of sponsorship withdrawal can be severe, including visa curtailment, forced departure from the UK, financial loss, emotional distress and long-term damage to immigration history.
