Hello everyone! Today we are going to talk about a few HR laws that are important to our business. First, let’s talk about Equal employment opportunity laws. These are laws that prohibit specific types of discrimination in the workplace. This ranges from Age to disability, military status to pregnancy, race, religion, and sexual orientation. EEO is regulated by both the Civil Rights Center and The Office of Federal Contract Compliance Programs. The Equal Employment Opportunity Commission, also known as the EEOC, enforces federal laws making discrimination against job applicants illegal. Disparate Treatment is intentional discrimination. This is clearly treating individuals differently due to characteristics that are not job-related. Disparate Impact is unintentional discrimination. These are policies that are put in place that can unintentionally impact a whole group of people. As you can see, Disparate treatment is direct, unequal treatment. Disparate impact, on the other hand, happens through neutral actions and is indirect. Bona Fide Qualifications allow employers to use certain characteristics to make decisions for certain jobs. An example would be the mandatory retirement age for occupations like airplane pilots. The Civil Rights Act of 1964 made it illegal for employers to discriminate based on sex, race, national origin, color, and religion. It also made promotions, demotions, and compensation based on any of these characteristics illegal. Title 7 of the Civil Rights Act says that employers meeting any one of their listed criteria must follow the rules and regulations outlined in the Civil Rights Act. • These include: All private employers of 15 or more employees • All educational institutions, both public and private • State and local governments • Public and private employment agencies • Labor unions with 15 or more members • Joint labor There are two types of Sexual harassment in the workplace. Quid pro quo and hostile work environment. In quid pro quo, a positive outcome happens in return for a sexual favor. Hostile work environments are created when an individual’s performance or mental well-being is impacted due to intimidation or offensive working conditions.
