United States Environmental Protection Agency | 792 F.3d 281 (3rd Cir. 2015) The Clean Water Act gives the Environmental Protection Agency, or E P A, the authority to set a total maximum daily load, or T M D L, to help reduce pollution in specific waterways. But what does the term total mean? We’ll see whether the term total represented more than just a number in American Farm Bureau Federation versus Environmental Protection Agency. The Chesapeake Bay watershed is over sixty four thousand square miles. Due to its size and ecological importance, the E P A set a T M D L to help reduce pollution in the bay. The E P A created a T M D L that set the waste load allocation for nitrogen, phosphorous, and sediment discharged by point and nonpoint sources into the bay. The T M D L also included target dates for implementation and required a reasonable assurance from states that they would implement the T M D L. The American Farm Bureau Federation sued the E P A in district court, claiming that the E P A exceeded its authority when it created deadlines and set specific pollutant allocations from point and nonpoint sources. The farm bureau argued that the term total load could only be represented by a number that was measured on a scale from low to high. The district court granted a summary judgment in favor of the E P A and held that the E P A’s interpretation of T M D L under the Clean Water Act was reasonable.
