CME Watch: ACCME Compliance Tips

Hello, and welcome to AOE Consulting’s bi-weekly video blog, CME Watch. Recently, the ACCME posted a list of compliance reminders for providers based on identified, recurring compliance issues noted during the most recent accreditation review cycle in December. The first compliance reminder is that employees of an ACCME-defined commercial interest are prohibited from participating in accredited CME activities as faculty members or as planners. There are, however, three situations that create an exception to this rule, yet maintain compliance with the ACCME’s Criterion 7, Standard 1.1, which addresses independence. These situations include: 1. Employees of ACCME-defined commercial interests are permitted to report about research and discovery, 2. They may demonstrate the operational aspects of the use of a device, and 3. Employees of an ACCME-defined commercial interest may control content that is not related to the product lines or services of the commercial interest with which they are employed. The second compliance reminder relates to the definition of a commercial interest. The complete definition of a commercial interest should be used in a providers’ policies and forms where applicable. Paraphrased or partial use of this definition can lead to non-compliance with Criterion 7 and Standards 1, 2 and 6. The third compliance reminder highlighted by the ACCME has to do with resolution of personal conflicts of interest. Accredited providers must ensure they are asking for all relevant financial relationships, as opposed to significant financial relationships, when obtaining disclosure information from individuals in control of content. “Relevant financial relationships” are defined as financial relationships in any amount, not a significant amount Related to resolution of personal COIs, accredited providers are being reminded to collect this information for not only individuals in control of CME content, but their spouse or life partner as well. The final compliance reminder called out by the ACCME, underscores required independence from commercial influence. Commercial interests are not allowed to control CME content in any manner. This includes influencing planning steps, implementation milestones and the reconciliation of a CME activity. It must be clear that the accredited provider makes all content decisions independently, with no influence from any commercial interest.
