Are Gerber Knives Ripping Off Benchmade Knives?

How is it Gerber is using an Axis Lock on this knife? Is this patent theft? Or is something else going on here? As promised, the name of the knife is the Sedulo. So glad I stumbled upon this knife while watching a video by Gideons Tactical. It is built identically to any Benchmade Axis lock knife and is actually quite a handy knife. I'm really enjoying it and after doing the necessary modifications to it as I explain in the video, it is even a nicer knife. Very smooth opening and it also really is holding an edge quite nicely due to the fantastic heat treat on the S30V. The handle is said to be green. Sure, I'll buy that. What I do like is the texture and also the deep pocket clip. What is still shocking me is the fact that it is an Axis lock. Did the patent expire on it? Did Benchmade license it to Gerber? Are there enough subtle differences that it is not really considered an Axis Lock? To that last one, I say know. I took the knife completely apart and it is identical to a Benchmade.
