How do I get a 2nd opinion on my criminal case? Okay, so you have a pending criminal case, and for whatever reason under the sun you’re not happy with your lawyer and you want a 2nd opinion. How do you go about getting it? This is one of the most common issues that I get in my practice. People contact me all the time asking for advise on their pending criminal cases, and while I’m happy to talk about a fresh arrest, and sometimes I’m able to offer an opinion on a generic question in a pending case, the fact is that if you’ve got a lawyer working for you on a case that’s in litigation, then the odds are that I’m not gonna second guess another lawyer who knows more than me about the case, and play Monday morning quarterback over the internet or telephone, especially based on whatever proffer that you wanna offer up and without becoming familiar with the totality of the case’s circumstances. So here’s a newsflash: If you want me to give you a competent 2nd opinion on a pending case - not a new arrest but an existing case that’s in litigation and has a lawyer working on it - then you’re gonna have to first provide me with complete copy of your file, including all items of discovery, so that I can take a comprehensive and unbiased look at the case and then provide you with an informed opinion. You probably wouldn’t seek a 2nd opinion about surgery on the internet (at least I hope you wouldn't, I know that I wouldn't; I’d take my X-Rays, MRI, blood work, whatever to another surgeon's office, engage in a detailed consultation and get an "informed" 2nd opinion, which is precisely what you should do with your pending criminal case).
