He wasn’t a murderer. He wasn’t even convicted. Yet, he spent 3 years behind bars… waiting. Waiting for a trial. Waiting for a judge. Waiting for justice. And he’s not alone. This issue also results in overcrowding—severe overcrowding—in jails. Against the sanctioned capacity of 5,200 inmates, Tihar Jail currently houses 13,134 prisoners, of whom 11,975 are undertrials. And this isn’t just Tihar’s story—8 in 10 prisoners in Indian jails are undertrials, still awaiting justice. To tackle overcrowding, the Delhi government is set to relocate Tihar Jail—the largest prison complex in South Asia—to the outskirts of the national capital. For this, Delhi Chief Minister Rekha Gupta has allocated ₹10 crore in the 2025-26 budget for survey and consultancy services related to the shifting. While relocating Tihar and decongesting prisons is a step in the right direction, it raises a critical question: What about the delayed delivery of justice?
