CULTIVATING MARIJUANA Colorado law permits adults 21 and older to home-grow up to six cannabis plants in their residence under the following five conditions: 1) No more than 3 of the plants can be mature and flowering. 2) The plants must be in an enclosed and locked space. 3) The plants may not be visible from the outside, such as through a window. 4) There may be no more than 12 marijuana plants in one residence, even if more than two adults live there. And 5) If people under 21 live in the residence, the plants must be in an enclosed and locked area. And if people under 21 visit the home, the plants must be reasonably inaccessible to them. A first-time conviction of having more than 12 plants in your residence is a level 1 drug petty offense, punishable by up to $1,000 in fines. And the conviction can be sealed one year after the case ends. But subsequent convictions are prosecuted as either a drug misdemeanor or a drug felony depending on the number of plants involved.
