Keeping genetically modified (GM) fish in aquariums in Brazil can have significant legal implications, especially because IBAMA (Brazilian Institute of Environment and Renewable Natural Resources) regulates the use, creation and commercialization of genetically modified organisms (GMOs) in the country. Main Legal Implications: 1. Regulation by CTNBio (National Technical Commission on Biosafety) The Biosafety Law (Law No. 11,105/2005) requires that any GMO (including modified fish) be evaluated and approved by CTNBio before being created, commercialized or released into the environment. If the fish is not authorized, its possession is illegal. 2. Inspection by IBAMA IBAMA can inspect aquariums suspected of keeping unauthorized species. - If the fish are considered unregulated GMOs, the owner may be charged with an environmental crime (Law No. 9,605/1998 – Environmental Crimes Law). 3. Environmental Risks If the fish escape into the environment, they may unbalance ecosystems, compete with native species or transmit modified genes. This may constitute environmental damage, subjecting the person responsible to fines and legal action. Possible Penalties for the Owner: Heavy fines (values may reach R$50 million in serious cases, according to the Environmental Crimes Law). Seizure of the animals and the aquarium. Criminal proceedings for non-compliance with the Biosafety Law (art. 24 of Law No. 11,105/2005). Civil liability if there is genetic contamination in the environment. If genetically modified fish do not have authorization from CTNBio/IBAMA, keeping them in an aquarium is illegal. In the event of inspection, the owner may be subject to administrative, civil and criminal sanctions.
