As the parties reflect on two decades of investor-State arbitration under NAFTA, key lessons emerge: What has worked, what hasn’t and what changes might be needed to protect the States’ regulatory space and investors’ legitimate expectations? Is touching what remains of NAFTA, now under the current USMCA, on investor-State dispute resolution between the United States and Mexico, premature?
