"You aren't being charged with a crime, but you aren't free to go." In this video, I’m leaving "The Spot on the Alley" in Seneca when I am intercepted by Seneca PD. After being harassed by a patron inside for wearing an Antifa hat, the police decided to place me under "investigative detention." The catch? The officers admit ON CAMERA that I haven't committed any crime. They held me against my will solely to facilitate a civil trespass notice—a clear violation of the Fourth Amendment. Watch as: Officers struggle to explain their Reasonable Articulable Suspicion (RAS). I am threatened with arrest for standing on publicly owned parking (notice the utility poles and boxes!). The Constitution doesn't take a night off just because a business owner is offended by a hat. Know your rights. If there is no RAS of a crime, there is no lawful detention. What do you think?
