In a landmark judgment delivered on December 10, 2025, the Supreme Court of India held that a woman facing sexual harassment by a third-party outside employee at her workplace can file her complaint before the Internal Complaints Committee (ICC) of her own organization. She is not required to approach the ICC of the accused’s establishment; dismissing an IRS officer’s appeal. The bench of Justices J.K. Maheshwari and Vijay Bishnoi ruled that a narrow interpretation restricting jurisdiction only to the respondent’s workplace would defeat the remedial and welfare objectives of the POSH Act.
