That much is not disputed. What's disputed is why. The State charges Duren, 38, with first-degree murder, second-degree murder, reckless conduct with a deadly weapon, and endangering the welfare of a child. Prosecutors allege Duren shot Naffziger during an argument in their living room, then fled with their daughters, triggering a statewide Amber Alert that ended in an Applebee's parking lot in Keene, 170 miles away. The defense invokes New Hampshire RSA 627:4, which allows deadly force to prevent kidnapping. They claim Duren reasonably believed Caitlyn was about to take their daughter Eloin and flee, making his use of deadly force legally justified.
