Oftentimes we have people who come in and either they're takers of marijuana or the other parent is, and they want to know is marijuana use going to affect the child custody arrangements? How is the court going to approach it?  Now, each court is going to be different there's a courthouse in every county and judges in every county, so there's going to be some variation, but by and large, judges will approach the question of marijuana in a couple different ways.   One marijuana use, despite the fact that it's legal is still looked upon in many counties as a little bit worse than alcohol use partly because it's something that's different and it's new and it was illegal for most of their legal education and training.  But really what the judge is going to look at is frequency quantity, and place of use. But if you're smoking pot all the time, and lots of it, it's going to negatively impact what parenting plan you're able to come up with from the judge, because the judge will look at how it's going to impact your ability to parent.  Parents who are high. Parents who are drunk tend to not make as good decisions as sober parents. And if you have a situation where marijuana is a major impediment or a major concern having that investigated will be something that you want to look at. And yeah, even though it's legal. It's going to negatively impact your ability to get exactly what you want in a parenting plan, unless you really want other parent to have the kids most of the time without any restrictions, and depending on your use in history, you might have the restrictions put on you to protect the kids.  If you have any questions, comment below.
