In Islamic law, animals are generally divided into land animals and sea creatures, and each category has its own rulings. Fish and other sea animals fall under a distinct category where the requirement of slaughter (zabah) does not apply in the same way it does for land animals. The Qur’an explicitly allows the consumption of sea life without attaching the condition of slaughter. Allah says that the food of the sea has been made lawful, indicating ease and general permission. From the Sunnah, we learn that the Prophet ﷺ allowed the eating of fish that had already died naturally in the sea, such as the famous incident of the large sea fish eaten by the Companions during a journey. This establishes that death in water itself is sufficient for permissibility. The wisdom behind this ruling lies in human ease and practicality. Fish cannot survive outside water, and performing a conventional slaughter like land animals is neither practical nor required. Islamic law is based on fitrah (natural order) and taysir (ease), not unnecessary hardship. Therefore, the Shariah recognizes the biological nature of fish and does not impose conditions that contradict reality. According to Javed Ahmed Ghamidi, the principle is simple: zabah is required only where the Qur’an and Sunnah require it. For sea animals, Allah has already declared them lawful without specifying slaughter, so adding extra conditions would be an innovation rather than piety.
