Lawyer who handled Sh23 million land deal may now testify against his own client

An advocate was forced into an ethical dilemma at the Milimani Law Courts after the prosecution revealed that he had recorded a statement with police in the same Sh23 million land deal case he was appearing in — making him a potential witness. In the case before Magistrate Lucas Onyina, the lawyer asked the court to defer plea so that his client, Stephen Mburu Paul, could seek alternative legal representation. The prosecution opposed the request, arguing the accused had already been advised of the conflict. The court ruled that the advocate could not act for the accused but ordered Stephen Mburu Paul to proceed and take plea on a charge of conspiracy to defraud.
