Months after Ohio’s recreational cannabis launch, several businesses have filed a lawsuit against the Ohio Division of Cannabis Control (DCC), accusing regulators of illegally restricting advertising and product approvals in violation of Issue 2, the voter-approved legalization law. Filed in Franklin County Court, the complaint says the DCC is applying outdated medical rules to adult-use cannabis without proper hearings or rulemaking. “These rules are invalid and unenforceable,” the affidavit states. 🏛️ The Case Against the State Plaintiffs include The Ohio Cannabis Company in Piqua and Ancient Roots LLC in Wilmington. They argue DCC rules make it nearly impossible to market products or expand operations. Current restrictions include: Every product must be pre-approved with a $200 fee. Names like Strawberry Shortcake and Rainbow Runtz are banned. Logos can’t appear on lighters, and slogans like “feel better” are prohibited. Even a “Merry Christmas” sign was rejected for “appealing to children.” “I’m not asking for billboards,” said Brian Wingfield, co-owner of Ohio Cannabis Company. “But there should be fair ways to reach adult customers.” 📊 The Market at Stake Since sales began in August 2024, Ohio’s cannabis market has hit $802 million in sales, but operators say restrictive rules are stalling growth and undermining voter intent. Wingfield said businesses have spent thousands on compliance only to face vague enforcement. 🚫 State’s Defense The DCC says its goal is to protect minors, but operators argue they already use strict age verification online and in-store. ⚖️ The Bigger Fight The suit claims DCC is “destroying the will of voters” by blocking what Issue 2 legalized.
