On Thursday morning, Dr von der Leyen issued a statement announcing that the European Union had sent a letter of formal notice to the UK Government concerning its intention to take legal action unless ‘problematic provisions’ in the country’s Internal Market Bill are removed. The Internal Market Bill prepared by UK Prime Minister Boris Johnson breaches articles of the Brexit Withdrawal Agreement concluded in 2019, particularly elements that pertain to the Northern Ireland Protocol. Taking to Twitter on Thursday, Dr von der Leyen wrote: ‘Good discussion with @MichealMartinTD on #NextGenerationEU & ongoing negotiations with UK. ‘We share the view that that Protocol on Ireland/Northern Ireland is essential for maintaining peace and stability on the island of Ireland and protecting the integrity of the Single Market.’ Mr Martin travelled to Brussels on Thursday to attend a two-day summit with other EU leaders, during which issues including EU relations with Turkey, ongoing political unrest in Belarus and Brexit negotiations will be discussed. Mr Martin met with Dr von der Leyen to communicate his assessment of the likely impact on Ireland if the EU and the UK fail to negotiate a trade deal before the end of the Brexit transition period, as well as the importance of safeguarding the peace process in Northern Ireland. In her statement on Thursday, Dr von der Leyen stated that the UK Government’s Internal Market Bill constitutes a ‘breach of the obligation of good faith laid down in the Withrawal Agreement’, and would be ‘in full contradiction to the protocol of Ireland and Northern Ireland’. Stating that a letter of formal notice of infringement proceedings had been dispatched, the German woman added: ‘The letter invites the UK Government to send its observations within a month, and besides this, the Commission will continue to work hard towards a full and timely implementation of the Withdrawal Agreement. ‘We stand by our commitments.’ Under the terms of the Brexit withdrawal agreement concluded in October 2019, Northern Ireland will technically leave the EU Customs Union and Single Market along with the rest of the UK when the Brexit transition period ends on December 31, but will continue to abide by the bloc’s regulations, and will be subjected to the oversight of European authorities, until at least 2024.
