Valve will win the UK lawsuit because allowing the case to proceed does not mean Steam has been found to have broken competition law. It only means the claim met the minimum threshold to be heard. Under UK competition law, even a dominant company is not acting unlawfully unless there is clear abuse of that position. Valve can argue that Steam’s size is the result of competitive success and consumer preference, not exclusionary conduct, and that developers voluntarily choose to use the platform because of the value it provides. In addition, Valve is likely to argue that the practices challenged in the UK lawsuit, such as platform commissions and contractual terms, are common across the digital games industry and therefore not inherently anti-competitive. A key weakness for the claimants is proving direct consumer harm. Game prices are set by publishers, not Steam, and price levels are influenced by many factors beyond Valve’s fees. If the court finds the economic evidence speculative or unconvincing, it may conclude that Steam’s conduct does not amount to an abuse of dominance, strengthening Valve’s chances of winning the case.
