LaFace Records, 329 F.3d 437 (2003) Civil rights activist Rosa Parks rose to fame when she refused to move to the back of a racially segregated bus. When rap group OutKast named an explicit song after her, Parks took the band to court in Parks versus LaFace Records. The song entitled “Rosa Parks” was the first single released from OutKast’s album Aquemini. A sticker on the album contained a Parental Advisory, warning that the song contained explicit content. The lyrics mentioned moving to the back of the bus but didn’t mention Rosa Parks or civil rights. Parks sued OutKast and its producer, LaFace Records. She claimed that the use of her name constituted false advertising under the Lanham Act and intruded on her state common-law right of publicity. Parks pointed out that the “Rosa Parks” title misled consumers into thinking she approved the song. She supplied affidavits from several people who thought she was somehow affiliated with OutKast. OutKast argued that even if the use of Parks’s name as a song title created risk of consumer confusion, that risk was outweighed by its First Amendment rights. The district court granted OutKast summary judgment. Parks appealed to the Sixth Circuit. Want more details on this case?
