The Harper Government has passed legislation to amend Health Canada's Medical Marijuana Access Regulations (MMAR) and plans to enact the 'New Regulations' on March 31, 2013. The proposed New Regulations will prohibit self-cultivation of strain-specific plants and patients will have to become a registered client of a Licenced Producer and purchase Health Canada approved and authorized cannabis strains and qualities and the licence will be valid for two years instead of the current requirement to renew licences annually. The New Regulations will require have a direct and profound impact upon existing patients with MMAR Authorization to Possess (ATP) licences to use and cultivate cannabis for medicinal purposes. Health Canada's Medical Marihuana Access Program is now over a decade old and many patients with licences to cultivate have developed unique and highly successful strains of cannabis for the many varied applications being re-discovered daily by practicing 'cannabis phytotherapists'. Phytotherapy is the use of grasses as medicine and is a highly successful ancient practice and North America's First Nation peoples were also its first 'phytotherapists' using various grasses to maintain not only their mental and physical well-being but also their spiritual well-being through the use of sweetgrass in smudging ceremonies. Not unlike cannabis, sweetgrass was illegal until the early 1970's when the Indian Brotherhood, imprisoned First Nation members, lobbied the federal government to have this unjust law overturned and the plant restored to its rightful place. Jason Wilcox founder of Cannabis in Canada launched the 'MMAR PPL/DPL Coalition Against Repeal'; a coalition of cannabis activists including Marco Renda from Treating Yourself and the Urban Grower, Nadine Bews director of the Cannabis Wellness Centre of Alberta, Lisa Mamakind with ----et al (add whomever you wish to broadcast is on the team and have no objection to being noted) The purpose of the MMAR PPL/DPL Coalition Against Repeal is to: 1. Prevent some or all of the new regulations from becoming law. 2. Maintain the status quo until reasonable access is assured for those patients having the right to access is fair and reasonable. 3. File a class action lawsuit for damages if the MMAR Regulation Repeal becomes law. In order to prevent some or all of the New Regulations from becoming law the 'cannabis coalition' is currently raising funds to file a 'federal court injunction' under the legal guidance of lawyer, John Conroy, a well know expert on 'cannabis case-law' and legal counsel to Marc Emery whom has been incarcerated for the past 3 years in an American prison for selling seeds online to American customers also courtesy of the Harper government. In order to comply with Section 7 of the Canadian Constitution's Charter of Rights & Freedoms, the New Regulations must be a 'reasonable limit' on the right of access in all aspects and not be unreasonable. The members of the cannabis coalition MMAR PPL/DPL Against Repeal unanimously agree that there is enough evidence of immeasurable personal harm and financial hardship that will come from dis-allowing the personal cultivation of strain specific plants. At the present time the cannabis coalition is researching license holders to determine if there is a good Representation Action that can be taken to seek 'declaratory and injunctive relief' to prevent the implementation of some or all of the new proposed Regulations and to maintain some or all of the status quo to ensure that Constitutional Rights are respected. It is now over 50 years since Dr. Raphael Mechoulim isolated the delta-nine-tertahydrocarbinol molecule (CB1) and we have long since identified the human endocannabinoid system and its all of its functions however, we have yet to acquire data on the healing properties of cannabis phytotherapy. Universities throughout Canada and the world are constantly uploading reporting Youtube videos reporting the scientific discoveries of the cannabis plant and cannabis wellness centres and patients throughout Canada are claiming the miraculous healing qualities of 'phytocannabinoid therapy' on Facebook and Twitter. Health Canada is open to submissions for amendments to the New Regulations until February 28, 2013. The present time the PPL/DPL Coalition Against Repeal is gathering IMPACT STATEMENTS from not only persons having a MMAR Licence to Produce (ATP) but anyone who may not have ATP but are forced to purchase product through the blackmarket. Health Canada's deadline for submission is March 31, 2012 and time is of the essence and the cannabis coalition is making an urgent appeal for IMPACT STATEMENT from everyone affected including patients, caregivers, cultivators and family, friends and supporters.
