What is a Breach of Contract? In this video, Attorney L. Reed Bloodworth explains what a breach of contract is, and what you should do first when it happens? If there is a breach of contract you want to be able to prove a material breach of contract -- meaning that something very significant regarding the contract did not happen, was not performed by one of the parties. So what should you do when a vendor, a partner, a business or a group fails to meet the expectations and promises outlined in a contract? Do you call the breaching party to resolve it yourself or should you go straight to a breach of contract lawyer? Reed explains that a contract has several key elements: 1. It must have an offer. 2. It must have acceptance. 3. It must have consideration. 4. Finally, a breached contract must have DAMAGES to show that someone suffered a financial loss from the breach of contract.
