Avianca, Inc., in which plaintiff Roberto Mata sued the Colombian airline company for personal injuries allegedly caused by a flight attendant. The airline defendant in that case filed a motion to dismiss the plaintiff's case. We'll look at eight questionable citations to "case law" that the plaintiff's attorney cited in his response. Next, we'll look at the defendant's reply in which they called attention to the fact that a number of the cases cited in the plaintiff's response did not seem to exist. After that, we'll review several orders from the court concerning the matter as it unraveled what had happened. We'll also hear from the plaintiff's attorneys, who ultimately admitted to using ChatGPT to research case law. ChatGPT not only fabricated the citations to cases that do not exist, it fabricated entire quotations from those cases that the plaintiff's lawyer then used in support of his arguments. To make matters worse, when ordered by the court to attach copies of the questionable opinions that he had cited, the plaintiff's lawyer attached entire legal opinions. We'll look at one of the fabricated opinions that the attorney attached to his affidavit. Next, we'll discuss how one federal judge has responded to this incident by creating the first ever "Generative AI Certification" that all lawyers appearing in his court must sign at the outset of their case. At the end of the video, I'll answer several questions you may have and then share my thoughts on the implications that this ordeal may have on our legal system going forward.
