ICC Illegal Arrest of Former President Duterte in the Philippines By Genalin Hatamosa Actub Former Philippine President Rodrigo Duterte was arrested in Manila, Philippines, last March 7, 2025, at the International Airport upon arriving from Hong Kong with his wife and youngest daughter, Kitty Duterte. He was transferred to the ICC’s custody; he is currently in the custody of the International Criminal Court in Hague, Netherlands, while facing charges of a crime against humanity for the “War on Drugs”. But the ICC breaks the Law, including paragraph 59 of the ICC’s Rome Statute. The ICC illegally arrested Former President Duterte, according to paragraph 59. They have no jurisdiction in the Philippines and no right to do the warrant of arrest unless the Supreme Court of the Philippines approves it. It was ONLY AGREED by the Philippines Government, not by the Supreme Court. Now, they are challenging the ICC and the Philippines Government for an illegal, biased, and inhumane warrant of arrest. Do something Philippines Government and the Supreme court of the Philippines, protect your individual Filipino Citizen. Where’s human rights here Philippine Government and ICC? The International Criminal Court is designed to be independent of any political system or influence. Its mandates are to investigate and prosecute international crimes, such as genocide, war, and crimes against humanity, in an impartial and neural manner. The ICC independence is enshrined in its founding treaty. The Rome Statute, which ensures that the Court operates separately from any national or international. The International Criminal Court (ICC) generally cannot arrest a citizen within a specific country without that country's cooperation or approval. Here's why: 1. *Sovereignty*: The ICC respects the sovereignty of states, which means it cannot unilaterally arrest individuals within a country's territory. 2. *Complementarity*: The ICC operates under the principle of complementarity, which means it can only exercise jurisdiction if the country where the crimes occurred is unwilling or unable to investigate and prosecute. 3. *Cooperation*: The ICC relies on cooperation from countries to arrest and surrender individuals. If a country refuses to cooperate, the ICC may not be able to enforce an arrest warrant. 4. *Domestic courts*: In many countries, including those with a strong rule of law tradition, the domestic courts (such as the Supreme Court) have the primary jurisdiction to try crimes committed within their territory. However, there are some exceptions: 1. *UN Security Council referrals*: If the UN Security Council refers a situation to the ICC, the Court can exercise jurisdiction even if the country where the crimes occurred has not ratified the Rome Statute or cooperated with the ICC. 2. *ICC-issued arrest warrants*: If the ICC issues an arrest warrant, countries that have ratified the Rome Statute are obligated to cooperate with the ICC and arrest the individual if they are found within their territory. In summary, while the ICC generally cannot arrest a citizen within a specific country without that country's approval, there are exceptions, and the Court relies on cooperation from countries to enforce its arrest warrants. I’m appealing and calling the Philippines Government and ICC to rectify these issues. Filipino Citizens in the Philippines and in other part of the country will never stop giving tributes to Former President Rodrigo Duterte until you rectify this mistake, the Illegal arrest and inhumane, biased treatment of the Filipino Citizen specifically Former Rodrigo Duterte and a Lawyer. And if there's anything happens to the Former President Rodrigo Duterte, ICC will HOLD ACCOUNTABLE as he was arrested illegally, biased and inhumane, and he has a health issues and old age. Where's HUMANITY here, ICC and Philippine Government? Please don't ignore our plea and appeals to release Former President Rodrigo Duterte. AND, please RELEASE him as soon as possible as you're not abiding your ICC LAW paragraph 59. Where is his human right here? and being a Filipino Citizen forcefully arrested without due process in the Supreme Court in the Philippines. We are appealing to the ICC Presidency. I'm encouraging to all Filipino Citizen and all Humankind to pray Former President Rodrigo Duterte to be released soon by the Divine intervention our Heavenly Powerful and Mighty Father though the son Yeshua HaMaschiach Jesus Christ our saviour and deliverer and the Holy Spirit to do miracle things by releasing Former President Rodrigo Duterte and protect him and his family circle, as the Philippine country and all Kababayan. Remember Godhead, Jesus is real and alive. Protection and guidance to all of us humankind to the unseen and seen world.
