EP 18 Part 1. The Turks and Caicos Islands is predominantly a Common Law Jurisdiction. The Police Criminal and Evidence Act (PACE) is not applicable to the Turks and Caicos Islands. In relation to identification evidence especially recognition from CCTV footage, there are no guidelines in line with Code D in England and Wales for police officers to follow. However, the Turks and Caicos Islands Court of Appeal in the recent case of Jullimo Isma recommended that the Turks and Caicos Islands developed guidance along the lines of Code D. A failure to follow any proper procedure in CCTV footage recognition cases is likely to lead to the exclusion of evidence or a conviction being overturned as unsafe.
